This Privacy Policy describes how ACRECENTA DEVELOPMENT SL (hereinafter, interchangeably, “ACRECENTA”) collects, processes and uses the personal information of its clients and users, always supported by our commitment to privacy and information security, and ensuring that data are collected exclusively for specific, explicit and legitimate purposes and may not be processed in a manner incompatible with those purposes, in strict compliance with the applicable regulations on personal data protection, in particular Regulation (EU) 679/2016, the General Data Protection Regulation (hereinafter, the GDPR), and Organic Law 3/2018 on Personal Data Protection and Guarantee of Digital Rights (hereinafter, the LOPDGDD).
This Privacy Policy will be updated periodically in order to clarify or reflect new practices in the management of our users’ privacy, or any legislative, case-law or interpretative changes issued by the Spanish Data Protection Agency or other Supervisory Authorities that may occur and must be applied, and it will be accessible at all times for consultation on the website www.acrecenta.com.

Means through which we process your data

Customer data
Our customers’ data will be processed for the purpose of providing the contracted services, as well as for fiscal, accounting and administrative billing management of the contractual relationship that legitimizes the processing of the data. We may also process our customers’ data on the basis of our legitimate interest in sending them updates or information related to our activity, products and services, promotions, events and discounts through our Newsletter. Website users’ browsing data will be processed solely for statistical and analytical purposes, in accordance with our cookies policy, as well as to provide information about our business activity and, where applicable, to address your queries and suggestions.
CV data
Likewise, we may process curriculum vitae data if data subjects send it to us by email. In such cases, the data will be processed solely for the purpose of participating in current or future recruitment processes.
Data collected through contact forms
We may also process personal data if data subjects send us queries, complaints or suggestions through the contact forms enabled for this purpose on our website, solely in order to respond to the request. Under no circumstances will we incorporate such data into other databases or send marketing communications by electronic means without the prior authorization of the data subject. Mandatory fields in each form will be identified as such. In the absence or inaccuracy of such data, ACRECENTA will not be able to correctly identify you and, consequently, the query record will be deleted.
Data from received emails
We will also process personal data if data subjects send queries, complaints or suggestions by email to the addresses provided on the website for this purpose. In this case, the data will be processed solely to respond to the request. Under no circumstances will we incorporate such data into other databases or send marketing communications by electronic means without the prior authorization of the data subject.
Data collected through our Social Media profiles
We may process data from Social Media users who interact with ACRECENTA’s profile pages on our accounts across the different social networks. The information provided by ACRECENTA on its social media profiles is for informational purposes only. ACRECENTA is not responsible for any errors contained therein, nor for any damages arising from its use. Regarding modification of your data on a social network, please note that, as you are using a platform external to ACRECENTA, you may do so through your profile settings on each social network. Newsletter subscription
Website users may subscribe to our Newsletter by completing the subscription form available on the website www.acrecenta.com. Newsletter subscribers’ data will be processed solely for the purpose of sending information about ACRECENTA’s activity, as well as informing them of updates, promotions, organized events or applicable discounts on our products or services, based on their prior consent. Subscribers may unsubscribe from the Bulletin / Newsletter at any time by using the unsubscribe procedure at the bottom of each Newsletter, or by notifying us in writing at dpd@acrecenta.com
Recipients of your data
ACRECENTA guarantees the confidentiality of personal data and will not disclose it to third parties without the prior authorization of the data subject. However, depending on ACRECENTA’s needs, we may communicate your data to the following recipients:
Service providers
ACRECENTA may outsource different services to external providers who will have access to personal data, which may include, by way of example and not limitation: distributors, lawyers and attorneys, auditors, consultants, financial institutions, cloud service providers and their IT servers, and other providers and professionals, who will process personal data as data processors on behalf of and for ACRECENTA. In such cases, providers will have signed personal data processing agreements limiting processing to the purposes of the service provided and always under the security measures required by applicable regulations.
Virtual POS (TPV) or payment platforms
ACRECENTA may disclose payment data to virtual POS (TPV) providers or other electronic payment platforms such as Braintree, in order to facilitate payment methods for our activities and services.
Public administration and authorities
We may disclose your data and any other information in our possession or accessible through our systems when required in accordance with applicable legal and regulatory provisions to the competent public administration, as well as to the competent public authorities. This will be done under a legal basis and solely for the purpose of fulfilling our obligations and preventing abuse of services or fraudulent activities in the services provided through our website.

Data retention
Customer data will be kept for the time necessary to fulfil the purpose for which it was collected and to comply with the legal obligations arising therefrom. Financial data will be kept in accordance with Law 58/2003, the General Tax Law.
Data relating to queries submitted by users through web forms, those received by email, as well as CV data, will be retained for a maximum period of one year from the date on which they were collected.
Data collected through cookies and/or tracking pixels, social media plug-ins, and website users’ browsing data will be retained for a maximum period of one year from the date of collection.
Newsletter subscriber data will be retained until the subscriber requests cancellation of the subscription, the subscription email account ceases to function, or the customer objects to receiving the Newsletter.
Data of users who access an ACRECENTA social network profile will not be incorporated into the company’s databases and therefore will be retained under the conditions and for the periods established by the corresponding social network.
